Colorado Criminal Defense Support

Both Lindsay and Kelly began their careers as Public Defenders in Denver handling misdemeanor, juvenile, and serious felony matters. Combined, they tried more than 75 cases to verdict. This experience, developed further over the course of a decade in private practice, provided them with a thorough understanding of all aspects of a criminal case from the pre-file investigation through sentencing and post-conviction litigation. 

As a result, the attorneys at 2nd Chair provide the support of an associate with partner-level experience and sophistication. 2nd Chair offers an array of services, including but not limited to serving as co-counsel for motions hearings and trials, complex case consultation, motions drafting, discovery organization and review, state-wide sentencing analysis for proportionality review, expert opinion letters for plea offers and case-specific issues, case strategy and brainstorming, and more.

Federal Criminal Defense Support

Lindsay and Kelly understand the degree of complexity and sophistication required to effectively defend a client charged with a crime in federal court. Lindsay and Kelly assist their attorney clients with complex legal research and motions drafting in the areas of search and seizure, challenges to warrants, competency, and more. They specialize in sentencing issues and can help with PSR objections, motions for variant sentence, and sentencing memos. Clients often ask Lindsay and Kelly to review various aspects of the United States Sentencing Guidelines as it applies to their client for purposes of criminal history, enhancements, offense level, and sentencing reductions.

*Both Lindsay and Kelly maintain a Criminal Justice Act (CJA) research contract. Kelly also has a CJA co-counsel contract.

state and federal Appeals
(Including Interlocutory and Bond Appeal)

Typically, appeals occur after final judgement. The attorneys at 2nd Chair have experience drafting a broad range of appeals, including state level appeals to the Colorado Supreme Court and federal appeals to the 10th Circuit.

Additionally, there are scenarios in which a trial court ruling impacts a defendant’s right to present a defense and an appeal after trial would be an inadequate remedy. For these scenarios, an interlocutory appeal is the best approach. These briefs demand a significant amount of time for legal research, review of the record, and persuasive writing.
